These terms cover your use of the Driftwaver Music app for Android phones and Android TV
(com.driftwaver.music). By using the app you accept them. If you do not, please stop
using it.
Driftwaver plays and generates ambient audio and binaural tones. It is a relaxation and focus aid. It is not a medical device: it does not diagnose, treat, cure or prevent any condition, and it is not a substitute for professional medical advice.
Any effect is personal and not guaranteed. If you have epilepsy, a seizure disorder or a pacemaker, or you are pregnant, speak to a doctor before using rhythmic audio. Do not listen while driving or operating machinery.
Driftwaver Pro is sold through Google Play as a monthly subscription that renews automatically until you cancel it. Google charges your chosen payment method at the start of each monthly period, at the price shown in your local currency before you subscribe. You can cancel at any time from the Google Play app or at play.google.com/store/account/subscriptions; cancelling stops the next renewal and you keep Pro until the end of the period you have already paid for. Payment, refunds, cancellations and taxes are handled by Google under its own terms; we never see your payment details.
Without a subscription the app remains usable, with limits shown in the app: local synthesis, binaural tones, the built-in library, your own files, and a limited number of exports and track analyses. AI generation is the part that needs Pro, because each generation has a real cost to us.
Pro unlocks features listed in the app at the time of purchase. Features may be added or changed over time. AI generation carries a monthly allowance, shown in the app; it exists because each generation has a real cost to us.
The tracks bundled with Driftwaver and offered for download were produced by us using an AI music service under a paid subscription that assigns the resulting audio to us. We own what there is to own in them, and we license them to you as follows.
The test is whether the music is part of something you made, or whether the music is the thing you are supplying.
Fine: background music in your video, podcast, stream, game, meditation class, or an advert you produce for a client.
Not fine: selling the track on a stock music site, including it in a downloadable music bundle, or shipping it as content inside your own app.
Commercial use of the first kind is exactly what this licence is for. It is the second kind — redistributing the audio as a product in its own right — that is not permitted.
This licence is non-exclusive. The same track is licensed to every other user on the same terms, and someone else may be using it in their work at the same time as you. If your project needs music nobody else can use, this library is not the right source for it.
When you use AI Generation, the track is produced from your description by a third-party model that we operate on your behalf. As between you and us, the result is yours, and you may use it commercially.
Two things you should understand about that:
If you need something recognisably your own, write your own description rather than using a built-in preset. Presets are shared by everyone.
Exporting a mix does not change where the parts came from. An export containing a library track stays under section 3; an export of audio you generated stays under section 4; an export of your own file stays yours. A mix of several is governed by all of them together — the most restrictive part sets the limit.
Audio you add from your device remains entirely yours. We do not upload it, analyse it remotely, or claim anything over it. You are responsible for having the right to use whatever you add.
Files you send to Driftwaver for Android TV are the one exception to "we do not upload it": they are stored in your TV's cloud library so the TV can play them. They remain yours. By sending them you allow us to store them and to stream them to the TV they were sent to, and nothing else: we do not listen to them, share them or use them for any other purpose. Send only files you have the right to copy for your own listening. We may remove a file when we receive a valid legal notice about it, and the library is deleted as described in the Privacy Policy. The cloud library is storage for listening, not a backup: keep your own copies of anything that matters to you.
The description you write is sent to a third-party AI provider. Do not put personal, confidential or identifying information in it, and do not use the feature to attempt to produce content that is illegal, hateful, or that impersonates a real person or recording.
AI output can be unpredictable. If a generated track is offensive or otherwise objectionable, report it with the Report content button beside the finished track, or write to us. We may decline to generate for prompts that breach these terms.
AI generation, cloud downloads and the TV cloud library depend on services we do not control and on your internet connection. They may be slow, unavailable, or withdrawn. Local playback, binaural tones and procedural synthesis work without a network.
Driftwaver is provided as it is. We do not warrant that it will be uninterrupted or error-free, that generated audio will meet your expectations, or that any particular output is protected by copyright or free of resemblance to other works.
To the extent the law allows, we are not liable for indirect or consequential loss, including lost profits or lost data. Nothing here limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
If these terms change materially, the date at the top will change and the current version will be published at this address. Continued use after that means you accept the new version.
